It is expected that the applicants applying for patents in the US with patents allowed in Korea can easily get the patent in the US.
Korea and the US agreed to sign an MOU including comprehensive mutual cooperation on the patent administration. According to the MOU, both countries will use the same form for application, harmonize examination standards and share patent databases improving cooperation on the patent matter.
Also, the pilot program of KoreanUS Patent Highway System will be adopted so that the patent allowed in Korea can be examined quickly with shortened period.
John Doll, the deputy commissioner of the USPTO, said in the interview that both countries agreed to sign an MOU for exchange of patentrelated information and comprehensive cooperation on patent administration aimed at improving administrative capability of PTOs of both countries.
The MOU includes eight project including harmonization of patent application forms, unification of standard classification system, sharing patent DB and improving exchange of personnel including patent examiners.
Due to the mutual use of patent examination results and sharing of patent DB, Korean companies can expect to obtain US patents more easily.
